1. Introduction

Welcome to BeeHype, a platform developed and operated by Workscale SAS, a simplified joint-stock company registered with the Trade and Companies Register under number 94953354100015, with its registered office located in France.

These Terms of Service define the conditions under which you may use our automated social media post generation and scheduling service. By accessing our website at beehype.ai or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Service Description

BeeHype is a Software as a Service (SaaS) that automates the generation of content for social media and publication scheduling. The Service is accessible by monthly subscription, with a free plan offering limited features.

Workscale reserves the right to modify, suspend, or discontinue, temporarily or permanently, all or part of the Service, without notice and without incurring any liability to you or any third party.

3. User Account

To use the Service, you must create a user account by providing accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.

You must be of legal age or a duly represented legal entity to use our Service. The Service is intended for both individuals and businesses.

You are strictly prohibited from:

• Providing false or misleading information during registration
• Creating an account for another person without their authorization
• Transferring your account to a third party
• Using the Service in a manner that could damage, disable, or overload it

4. Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or BeeHype cancels it. You may cancel your Subscription renewal through your account settings or by contacting our support team.

A valid payment method, including credit or debit card, is required to process the payment for your Subscription. You shall provide BeeHype with accurate and complete billing information. By submitting such payment information, you automatically authorize BeeHype to charge all Subscription fees incurred through your account.

Should automatic billing fail to occur for any reason, BeeHype will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

In accordance with French Consumer Code, you expressly acknowledge that the provision of the Service begins immediately after your subscription is validated and you explicitly waive your right of withdrawal. Consequently, no refund will be possible after subscription, except in cases provided for by law.

5. Fee Changes

BeeHype, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

BeeHype will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

6. Refunds

7. Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights.

You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

8. Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of BeeHype and its licensors. The Service is protected by copyright, trademark, and other laws of both France and foreign countries.

The content generated by BeeHype at the user's request is intended for the exclusive use of the user for their content creation. Workscale commits not to reuse, resell, or redistribute this content to third parties without your explicit consent.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of BeeHype.

9. Personal Data Protection

The protection of your personal data is a priority for us. All collected data is encrypted in our databases and processed in accordance with the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

Data is retained for a period of 2 years and is deleted if the user no longer uses the application. If you wish to delete your account, all your data will be destroyed instantly.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

11. Limitation Of Liability

In no event shall BeeHype, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

12. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

BeeHype, its subsidiaries, affiliates, and licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

13. Tax Provisions

The prices displayed for the Service may be indicated excluding or including taxes, as indicated on our website. VAT or any other applicable tax will be automatically added based on your country of residence, in accordance with applicable tax laws.

For business users established in the European Union and having a valid intra-Community VAT number, VAT may be self-assessed according to applicable rules. Users are responsible for providing accurate tax information.

14. Applicable Law

These Terms of Service are governed by French law. Any dispute relating to the interpretation, execution, or termination of these Terms of Service shall be submitted to the competent courts of Paris, France, unless otherwise provided by law.

15. Modifications to Terms

Workscale reserves the right to modify these Terms of Service at any time. Any significant modification will be notified by email or by a visible notice on the Service. Your continued use of the Service after the publication of the modified Terms of Service constitutes your acceptance of these modifications.
